Projx Membership Terms of Use Agreement

This Agreement provides important information about your projx membership, so you should take the time to read and understand the terms. You may review, save or print any part of this Agreement. We encourage you to print out a copy of this entire document and refer to it as you use the system.

IMPORTANT: IF YOU CHOOSE TO ACCEPT THIS AGREEMENT, YOU MUST DO SO AS IT IS PRESENTED TO YOU. NO CHANGES (ADDITIONS OR DELETIONS) WILL BE ACCEPTED BY THE DRPGROUP.

The drpgroup may change, add or remove any part of these Terms of Use, or any part of the projx services, features and systems without prior notice.

 

Using projx

To hold a projx account, you must be at least 16 years old. This Agreement sets out your rights and obligations as a projx user. You cannot use projx until you have accepted the terms of this Agreement, and you must abide by the terms of this Agreement in order to have the right to use projx. Your use of projx is also subject to the drpgroup's Client Privacy Policy. This applies to this Agreement and the Privacy Policy as they currently exist and as they may be revised from time to time by the drpgroup.

When you accept this Agreement and enter the projx system, you become the member. As a projx member, the drpgroup provides you with a limited, non-exclusive licence for no more than the term of your project contract with the drpgroup or any of its affiliated companies - including the use of your member name and number provided to you for your membership.

Your e-mail address, when confirmed by the drpgroup, is your online identity. You will be issued a random password, which will need to be changed the first time that you enter the site. Do not reveal your password to other users. Your membership and online content is at risk if you let someone use it inappropriately.

As used in this Agreement, "Content" means the text, software, communications, images, sounds, documentation and all other information and materials you encounter or generate through your account or on-line through the Internet.

 

Payment

Projxis provided as a FREE service exclusively to current clients, staff and suppliers that have existing or ongoing projects/contacts with the drpgroup and it's affiliated companies.

 

Cancellation

The drpgroup can cancel a user's membership without prior notice or reason. If a member wishes to cancel their membership or that of a colleague, this request must be initiated by a current member of projx via the email addresssupport@projx.net.

 

Availability of the service

While the drpgroup makes reasonable efforts to ensure that projx is available at all times, The drpgroup does not guarantee, represent or warrant that projx services will be uninterrupted or error-free, and drpgroup does not guarantee that users will be able to access or use all the projx features at all times.

The drpgroup may change, suspend or discontinue any (or all) aspects of projx at any time, including the availability of any projx feature. The drpgroup may also impose limits on the use of or access to certain features or portions of projx, or restrict your access to any part or all of projx, in all cases without notice or liability.

The drpgroup also does not guarantee or warrant that any content you may have linked to your membership on projx will not be subject to inadvertent damage, corruption or destruction. You are responsible for backing up, on your own computer, any important documents, images or other content. The drpgroup will not be responsible for any archiving or backup of any such information. If any data, messages, images or other content in your account and stored on the projx system is damaged, lost or corrupted in any way, The drpgroup will have no obligation or liability to you or your company/organisation.

 

Acceptable use policy guidelines

There are rules and standards that you must abide by when you use projx. These rules and standards are described in this Agreement. As a projx member, you agree to comply with this Agreement, and you acknowledge that the drpgroup has the right to enforce this Agreement in its sole discretion. This means that if you, or anyone using your projx membership to access the projx system violate the terms of this Agreement, the drpgroup may take any and all appropriate actions. This can range from the issuing of a warning about a violation to the termination of your access privileges for projx, to legal action - as the drpgroup deems necessary or appropriate. The drpgroup is not required to provide notice prior to terminating your projx access for violating these rules and standards, but we may choose to do so.

You are solely responsible for your conduct using your projx membership, including all content you upload or enter. The drpgroup will not be responsible or liable in any way for any such on-line distribution or publication. The drpgroup cannot and will not review every piece of content which may be generated or uploaded on or through your membership (although the drpgroup reserves the right to monitor members' use of projx), and the drpgroup will not be responsible for any content provided by a projx member.

Any content uploaded to projx must only be in direct relevant connection to an ongoing drpgroup project or contract. Any content found to be for use other than that stated will be removed without notice and may result in the cancellation of a member or group of members associated with the perpetrating member.

A member's use of projx should conform to the requirements of the law, respect for the rights of other users of projx and third parties, and current standards for communicating on-line. By your use of projx, you agree to use appropriate conduct and language when you are online—this includes (but is not limited to) following the rules of any ISP, any other on-line services, this Agreement and all applicable laws.

The drpgroup reserves the right to terminate your access to projx at any time, with cause or without cause, in the event of any breach of this Agreement by you (or anyone using your membership), your infringement of the drpgroup or projx or others' intellectual property, or any other circumstances which, in the drpgroup's sole discretion, merit termination.

Inappropriate conduct falls into a number of categories. The more commonly understood categories are discussed below, although this list is not exclusive.

 

Illegal, tortious and prohibited conduct

projxmay be used only for lawful and proper purposes. The laws and rules that apply in the off-line world must be obeyed on-line as well. Posting, transmitting, promoting, using, distributing or storing content that could subject the drpgroup to any legal liability, whether in tort or otherwise, or that is in violation of any applicable law or regulation, or otherwise contrary to commonly accepted community standards, is prohibited. This includes information and material protected by copyright, trademark, trade secret, nondisclosure or confidentiality agreements, or other intellectual property rights, and material that is obscene, defamatory, constitutes a threat, or violates export control laws.

Examples of prohibited conduct are:

  • Posting obscene content (including child pornography)
  • Planning illegal activity, such as building a bomb or counterfeiting money
  • Advertising a lottery, ammunition, firearms, tobacco, alcohol, illegal drugs and drug-related paraphernalia
  • Pretending to be anyone you are not - you may not impersonate or misrepresent yourself as another person including another projx member or a drpgroup employee; The drpgroup reserves the right to reject or block any projx username which could be deemed to be an impersonation or misrepresentation of your identity, or a misappropriation of another person's name or identity
  • Using false statements to get, or to attempt to get, account information or other private information from other projx or users
  • Engaging in copyright infringement or other intellectual property infringement, or disclosing trade secret or confidential information in violation of a confidentiality or nondisclosure agreement

The drpgroup reserves the right to cooperate with law enforcement authorities, including complying with warrants, court orders and subpoenas. In addition, the drpgroup reserves the right to comply with any civil court orders and/or subpoenas. If the drpgroup decides to investigate or resolve possible misuse involving you or anything you do on projx, the drpgroup is entitled, except to the extent prohibited by applicable law, to disclose any information about you in the drpgroup's possession in connection with your use of projx and anything you do with projx, to law enforcement or other government officials, as the drpgroup in its sole discretion believes to be necessary or appropriate. By your acceptance of this Agreement and your use of projx, you authorise the drpgroup to take any such actions.

 

Copyright and intellectual property infringement

Before you upload or download any content while using projx, make sure you have been given the legal right to do so by the owner of the content.

Making unauthorised copies of any content can lead to the termination of your projx access and may even subject you to legal action. In addition, the owner of the content may take criminal or civil action against you. If a content owner takes legal action against the drpgroup because of your unauthorised use of content, you agree (to the extent permitted by applicable law) to hold harmless and indemnify the drpgroup, its subsidiaries, affiliates, related companies, employees, officers, directors, agents and suppliers against any liability, claims, or demands, including the costs of the drpgroup hiring a legal practice to defend against the action.

 

Violations of system and network security

Violations of system and network security are prohibited, and may result in criminal and civil liability. The drpgroup will investigate incidents involving such violations and may involve and will report any suspected criminal activity to and cooperate with law enforcement. Examples of system and network security violations include the following:

  • Unauthorised access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without the express authorisation of the owner of the system or network
  • Unauthorised monitoring of data or traffic on any network or system without the express authorisation of the owner of the system or network
  • Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks
  • Falsifying your user identity or providing other false information to the drpgroup or to other users of projx in connection with your use of projx or any feature of projx
  • Posting viruses or software designed to create a virus or to do harm to projx, any projx members or users of projx, or any network
  • Taking any other action to disrupt the normal use of projx or the Internet by other users
  • Use of software that allows your account to stay logged on while you are not actively using the account

projxhas been designed for corporate use, and personal or non drpgroup related use is prohibited, including the following:

  • Soliciting for advertisers or sponsors
  • Posting sponsorships and third-party advertisements and content
  • Uploading content other than that for use directly by the drpgroup or affiliated companies
  • Using or providing to any third person or entity, whether or not for a fee, any directory of or information regarding projx users.
  • Disseminating multi-level marketing schemes, pyramid schemes, or commercial chain letters

 

Cookies

On projx, cookies are used to record information about your online preferences and allow us to identify you as you travel around our site, which enables us to track what pages you have looked at. Users have the opportunity to set their devices to accept all cookies, to notify them when a cookie is issued, or not to receive cookies at any time. The last of these means that certain personalised features cannot then be provided to that user and accordingly they may not be able to take full advantage of all of a website's features. Check the "Help" menu of your browser to learn how to change your cookie preferences.

During the course of any visit to projx, the pages you see, along with a cookie, are downloaded to your device. Many websites do this, because cookies enable website publishers to do useful things like find out whether the device (and probably its user) has visited the website before. This is done on a repeat visit by checking to see, and finding, the cookie left there on the last visit.

Information supplied by cookies can help us to analyse the profile of our visitors and help us to provide you with a better user experience.  They also are used to identify you as you browse our sites.

Please note that during your visits to our websites you may notice some cookies that are not related to drpgroup. When you visit a page with content embedded from, for example, YouTube you may be presented with cookies from this website.  drpgroup does not control the dissemination of these cookies. You should check the third party websites for more information about these.

 

Authorisation to remove content

The drpgroup reserves the right without member notification, to remove any content you may have uploaded on projx under the following circumstances:

  • On completion of a project or contract with the drpgroup
  • If content is deemed to be to large for the projx system capabilities
  • If content is in appropriate in any way described within the Terms of Use
  • Upon expiration of your membership period if applicable.

The drpgroup may update its Terms of Use from time to time. When we change the policy in a material way a notice will be posted on projx along with the updated Terms of Use.
